PERSONAL DATA PROTECTION CONDITIONS

Basic provisions
1. Operators of personal data according to § 5 let. o) of Act no. 18/2018 Coll. on the protection of personal data as amended (hereinafter referred to as the “Act”) is ALMER s.r.o. Company ID: 44 907 427 with registered office at Zahradna 19, 08001, Prešov (hereinafter referred to as “Operator”).

Personal data pursuant to Article 4 (1) of the General Data Protection Regulation (GDPR) are any information relating to an identified or identifiable natural person (“the data subject”); an identifiable natural person is a person who can be identified directly or indirectly, in particular by reference to an identifier such as name, identification number, location data, online identifier, or by reference to one or more elements specific to physical, physiological, genetic, mental the economic, cultural or social identity of that individual.
4. This website mainly collects personal data used for your information (the DG SAS provides information in accordance with Act No. 211/2000 Coll.), Receipt and processing of your requests, for sending the Newsletter (we do not currently have the service activated), if you have ordered this, or to process your questions and improve our offer, services for you. According to the law, the processing of personal data also means that we have personal data at our disposal, even if we do not dispose of it. For example, if you write an e-mail and we have your name (or nickname) and e-mail address.

– date of access and time of access;
– the amount of data transmitted;
– Identifying your browser and the operating system you are using.
6. The Operator has not appointed a responsible person for the protection of personal data.

1. The Operator processes personal data you have provided him or personal information that the Operator obtained by filling your order.
2. The Operator processes your identification and contact data and data necessary for performance of the contract.

Legal reason and purpose of processing personal data
1. The legal reason for the processing of personal data is :
– performance of the contract between you and the Operator pursuant to § 13 para. 1, par. (b) of the Act,
– the legitimate interest of the Operator in the provision of direct marketing (especially for sending business announcements and newsletters) pursuant to § 13 para. 1, par. (f) of the Act,
– Your consent to processing for the purpose of providing direct marketing (in particular for sending business notices and newsletters) pursuant to § 13 para. 1, par. a) of the Act in the event that the goods or services were not ordered.
2. The purpose of the processing of personal data shall be:
– execution of your orders and the exercise of rights and obligations arising from the contractual relationship between you and the provider; the order requires personal data necessary for successful order processing (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or
–
sending business announcements and performing other marketing activities.
3. There is no automatic individual decision-making pursuant to § 28 of the Act. You have given your explicit consent to such processing.

IV.
Retention period of personal data
1. The Operator keeps personal data
– We only process your personal data for as long as it is needed.
– for a period of 2 years if the consent to the processing of personal data for marketing purposes is withdrawn, if the personal data are processed by consent.
2. After the expiry of the personal data retention period, the controller shall delete the personal data.
V.
Recipients of personal data (subcontractors of the Operator )
1. The recipients of personal data are persons
– Involved in the provision of services / payments under contract,
– providing marketing services.
2. The controller intends to transfer personal data to a third country (outside the EU) or to an international organization. The recipients of personal data in third countries are providers of analytical tools.
3. Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses Cookies, text (temporary) files that are stored on the user’s computer and that enable the use of the website to be analysed. Usually, user-generated information about the use of this website is transmitted to a Google server in the United States and stored there. The IP address provided by your browser in Google Analytics will not be associated with other data from Google. You can prevent the storing of cookies by properly setting up your browser software. Your rights
1. Under the conditions set out in the Act you have
– the right to access their personal data pursuant to § 21 of the Act,
– the right to the correction of personal data pursuant to § 22 of the Act, or the limitation of processing pursuant to § 24 of the Act,
– the right to erasure of personal data pursuant to § 23,
– right to object to processing in accordance with § 27 of the Act,
– the right to data portability under § 26 of the Act,
– the right to revoke the processing consent in writing or electronically to the address or email of the Operator referred to in Art. III of these conditions.
2. You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to privacy has been violated.
VII.
Conditions for securing personal data
1. The Operator declares that it has taken all appropriate technical and organizational measures to secure personal data.
2. The Operator has taken technical measures to ensure data and personal data storage in paper form, in particular using secure passwords, protection programs and backups…..
3. The Operator declares that only the persons authorized by him have access to personal data.
VIII.
Final provisions
1. By submitting an order from the online contact form, you confirm that you are familiar with the terms of privacy and that you accept them in their entirety.
2. The Operator is entitled to change these conditions. It will publish the new version of the Privacy Policy on its website and at the same time send you a new version of these Terms and Conditions to your e-mail address, which you provided to the Operator.
These conditions come into effect on 25.5.2018.
